Following are citations from the Robert T. Stafford Disaster Relief and Emergency Assistance  Act, as amended (Stafford Act) and Title 44 of the Code of Federal Regulations (44 CFR), which address the eligibility of immediate threats that can reasonably be expected to occur within a five year period.<br />
Title IV, Section 403 (a) (3) (I) of the Stafford Act, establish that, “(a) In general &#8211; Federal agencies may on the direction of the President, provide assistance essential to meeting immediate threats to life and property resulting from a major disaster, as follows: (emphasis added).<br />
(3) Work and services to save lives and protect property &#8211; Performing on public or private lands or waters any work or services essential to saving lives and protecting and preserving property or  public health and safety, including a** (emphasis added).<br />
(I) reduction of immediate threats to life, property, and public health and safety” (emphasis  added).<br />
Please note that the Stafford Act does not define an immediate threat.  However, an immediate threat is defined in 44 CFR AS: 206.221 (c) under Definitions,  “Immediate threat means the threat of additional damage or destruction from an event which can reasonably be expected to occur within five years” (emphasis added).<br />
It must be assumed that the “immediate threat” defined in the 44 CFR is the same as the “immediate threat” cited in the Stafford Act.  Hence, the regulations and the Stafford Act support essential  work and services necessary to reduce immediate threats which can reasonably be expected to occur  within five years.<br />
Further, 44 CFR AS: 206.225 Emergency work, establishes that, “(a) General. (1) Emergency protective measures to save lives, to protect public health and safety, and to protect improved property  are eligible.<br />
(2) In determining whether emergency work is required, the Regional Administrator may require certification by local State, and/or Federal officials that a threat exists, including identification and evaluation of the threat and recommendations of the emergency work necessary to cope with the threat.<br />
(3) In order to be eligible, emergency protective measures must:<br />
(i) Eliminate or lessen immediate threats to live, public health or safety; or<br />
(ii) Eliminate or lessen immediate threats of significant additional damage to improved public or private property through measures which are cost effective” (emphasis added).</p>

				<content:encoded><![CDATA[<p>The North Dakota Department of Emergency Services has set up a hotline for North Dakota citizens who have sustained damage to private residences because of this spring’s flooding. The purpose of the hotline is to find out the scale of flood damaged homes within the state.<br />
The call center number is toll free: <span style="text-decoration:underline;">1-877-212-0316</span>. Hotline hours are 7 a.m. to 7 p.m. Callers will be directed through a series of simple questions. The call should only take a few minutes. Those impacted will also be referred to volunteer agencies that are providing assistance if necessary.<br />
Ransom County Emergency Manager encourages people to call the hotline if they have received any kind of water damage, either in their basements or on the main level of their homes, due to either river or overland flooding.</p>

Local law enforcement are asking residents to stay off the levees and dikes.<br />
“You have no idea if the levee has erosion underneath,” said Chief Jeanette Persons. “If you walk on the levees in weakened condition it could give way.”<br />
Also a concern is driving motorized vehicles or riding bicycles on the dikes and levees.<br />
“It just isn’t safe,” said Persons.<span id="more-358"></span><br />
The poly used to hold back erosion is very slippery and getting too close to it could also cause mishaps. The current is fast and very dangerous.<br />
Law enforcement are also asking residents to not go sightseeing on county roads as many are closed or washed out. An incident occurred over the weekend involving a vehicle driving into a washout eight feet deep and 10 feet wide.<br />
“The county roads aren’t safe,” said Deputy Chris Sandvig. “We don’t need people falling into washouts.”</p>

				<content:encoded><![CDATA[<p>The North Dakota Department of Emergency Services has set up a hotline for North Dakota citizens who have sustained damage to private residences because of this spring’s flooding. The purpose of the hotline is to find out the scale of flood damaged homes within the state.<br />
The call center number is toll free: 1-877-212-0316. Hotline hours are 7 a.m. to 7 p.m. Callers will be directed through a series of simple questions. The call should only take a few minutes. Those impacted will also be referred to volunteer agencies that are providing assistance if necessary.<br />
Ransom County Emergency Manager encourages people to call the hotline if they have received any kind of water damage, either in their basements or on the main level of their homes, due to either river or overland flooding.</p>

				<content:encoded><![CDATA[<p>The sanitary system is being compromised by people flushing items down the toilets that should not be flushed, even if the package says they are flushable.<br />
Flush only human waste and toilet paper down the toilet.<br />
The system is being over taxed due to items such as shop rags, bleach wipes, diaper wipes, hand wipes, diapers, q-tips, paper towels, Kleenex, sanitary napkins and tampons. These items get caught on the pump screens and have to be removed by hand. The system will fail and cause sewer backup if everyone is not vigilant in protecting the system.</p>

The Army Corps of Engineers raised the predicted crest based on new outflows from Bald Hill Dam. Lake Ashtebulah is at its maximum level requiring the Corps to release 7,500 cfs (cubic feet per second) which will raise the river level in Lisbon to 22 ft. The record level in 2009 was 22.86 ft.<br />
The outflows of 7,500 cfs is more than was released any time in 2009. The corps-managed dam plans to bring the pool level at Lake Ashtabula to its maximum level, 1,271 feet above sea level.<br />
The contractors, Dakota Underground, West Fargo will need to add two feet to the current level on the dikes they just finished raising Thursday, April 14.<br />
It is not yet known what the snow fall on Friday, April 15 will add to the river levels. By 7 a.m. Bald Hill Dam had received two inches of snow with 15 hundredths of an inch of moisture content. The winter storm warning is expected to continue until 9 p.m. Friday, April 15 with predicted amounts of up to 8 inches of snow for the area.</p>

<p>cautious basis travel to residents coming down 119<sup>th</sup> AV to 100 ST SE turning north on 118<sup>th</sup>.</p>
<p><strong>Two Claeys residences</strong> located in the SW corner of sec 31 are isolated with no access in or out.</p>
<p>Vehicle entrance is not attainable coming in from South Dakota or from Sargent or Dickey county road</p>
<p>systems.  Entrance only on foot.  114<sup>th</sup> AV SE going south to the residences shuts down for traffic 2 ½</p>
<p>miles from their home.  The families are fine and requesting no help at this time.  Contractors have</p>
<p>been notified for emergency repair as soon as conditions allow.</p>
<p><strong><span style="text-decoration:underline;">Rutland Township</span></strong></p>
<p><strong>Old Road 11</strong> from the City of Forman east to county Rd # 10</p>
<p><strong>134 AV SE</strong> beginning at Old Rd 11 south to 93 ST SE</p>
<p><strong>91 ST SE</strong> beginning at ND State Hwy 11 east to 134<sup>th</sup> AV SE.  For emergency access to residents in</p>
<p>this area please come in from ND state Hwy 11 on 91 ST SE and travel with extreme caution.</p>
<p><strong>93 ST SE</strong> beginning at ND State Hwy 11 east to 135<sup>th</sup> AV SE</p>
<p><strong>135<sup>th</sup> AV SE</strong> beginning at 93 ST SE south to 94<sup>th</sup> ST SE.  Emergency Access should come in from</p>
<p>Rutland City County Rd #3 to 135<sup>th</sup> AV SE.  Traffic cannot proceed past the Lock Residences.</p>
<p><strong>137<sup>th</sup> Av</strong> Beginning at County road # 3 going north one mile and turning west on 93<sup>rd</sup> ST.</p>
<p><strong>133<sup>rd</sup> AV SE</strong> beginning at county Rd # 3 south to 96<sup>th</sup> ST SE</p>
<p><strong>96 ST SE</strong> beginning at County Rd # 10 west to silver Lake and traveling around the lake to the north</p>
<p>on 135<sup>th</sup> AV to County Rd # 3.</p>
<p><strong>         136<sup>th</sup> AV SE</strong> beginning at County RD # 3 south to 96 ST SE</p>
<p><strong><span style="text-decoration:underline;">Bowen Township</span></strong></p>
<p><span style="text-decoration:underline;"> </span>        3 residential properties are isolated at this time.  The township is monitoring the situation and they are</p>
<p>all fine and require no help.  The issue is overland flooding causing road damage.</p>
<p><strong>The Lacina family</strong> is using 86<sup>th</sup> ST SE and turning north on 131<sup>st</sup> AV.  Planks are set up for foot traffic to get across the washout.  The road on the north side of the resident is flooded with no passage.</p>
<p><strong>The Olson Residence </strong>has a wash out on the north end of the mile on 131<sup>st</sup> AV SE and access from the south is flooded and washed out.   They are walking out to the north and being picked up by the nearest neighbor as needed.</p>
<p><strong>The Olafson residence</strong> has a washout located on 88 ST SE between 130<sup>th</sup> Ave SE and 131 Ave SE.  They also are walking out across planks of the washout and accessing their vehicles on the other side.  No access available from any other direction.  The township have these issues on their emergency list for tentative repair as soon as conditions allow and contractors are available.</p>
